Article 1. About us
These conditions of sale apply to the merchant website www.EmmaJonesParis.com managed by the company NAIL ADDICT with a share capital of €5,000 whose head office is located at 82 rue de Longchamp in Neuilly-sur-Seine, registered in the Trade Register. and Nanterre companies under number 524 873 858 which markets products to consumers and buyers. By using this site, you acknowledge having read these conditions and having accepted them. The EmmaJonesParis customer service number is: 01 46 37 60 17 (price of a local call). Article 2. Purpose
These conditions of sale aim to define the contractual relationship between EmmaJonesParis and the Buyer and the conditions applicable to any purchase made through the website www.EmmaJonesParis.com. The acquisition of a product through this site implies unreserved acceptance by the Buyer of these conditions of sale, of which the Buyer acknowledges having read prior to his order. Before any transaction, the Buyer declares, on the one hand, that the purchase of products on the site www.EmmaJonesParis.com is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have full legal capacity, allowing it to engage under these general conditions of sale. The EmmaJonesParis Company retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the Buyer.
Definitions:

"User" means any legal or natural person who uses this Site;

"Buyer" or "Buyers" means the Consumer who placed an Order for a Product sold on the Website;

"General Conditions of Sale or GCS" means these general conditions and online sales;

"Company" means the EmmaJonesParis Company, more fully described in Article 1 hereof.
Article 3. Products
The Products offered are those which appear on the Site, within the limits of available stocks. The Company reserves the right to modify the assortment of products at any time. Each product is presented on the Website in the form of a description containing its main technical characteristics (capacity, use, composition). The photographs are as accurate as possible but do not bind the Seller in any way. The sale of the products presented on the Site www.EmmaJonesParis.com is intended for all Buyers residing in countries which fully authorize the entry into their territory of these products. The Buyer declares to have full knowledge of the provisions of the product and agrees not to engage the responsibility of the seller subject to the application of the mandatory legal provisions.
Article 4. Prices and VAT
The prices of the products are those appearing on the site on the day of its consultation by the Buyer. The prices of the products are indicated in euros and include VAT, excluding delivery costs which remain the responsibility of the Buyer unless otherwise specified or specified. European Union countries are taxed at the current VAT rate. Other countries are exempt and pay duties upon entering their territory. Tax calculation is fully automated by the system. Customs Charges: Your order will be shipped from our office located in France. For member countries of the European Union, no customs fees will therefore be applied. Article 5. Process for placing an order
The User materializes his order by completing the following six steps:

Step 4. Access your account to confirm and complete the details required for delivery. If the Buyer does not already have an account on the Site, create his customer account and fill in the information required as to his identity.

Step 5. On the order summary page, expressly accept the general conditions of sale of the Site.

Step 6. Finally, the Buyer will be redirected to the secure online payment site to validate the payment. The final acceptance of the customer is therefore materialized by the validation of his bank details (credit card number, expiry date and cryptogram). The placing of an order by the Buyer implies full and unreserved acceptance by the latter of these general conditions of sale.
Order confirmation:
When your order is transmitted, you will receive by return an email confirming your order including the registration of your order, the details of the items ordered, personal data including the address and the delivery method. Cash on delivery orders and money order payments are not possible.
Order tracking :
To follow the progress of the processing of your order go to "My Account" in the online catalog. After logging in, you can view the status of your orders. "Not Processed": Your order is still being prepared. "Processed": Your order is ready to be collected by our carriers. You will soon receive an email from the carrier telling you that it has been collected.
Order Archiving:
The Buyer's basket is archived and kept for a subsequent order for a period of 30 days, even in the event of an interruption of the internet connection. The details of the order are archived in accordance with article L.134-2 of the Consumer Code, for a period of ten years on a secure server. However, no credit card number is stored. The Buyer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.
Article 6. Secure payment
EmmaJonesParis has set up a secure payment system for all orders placed on the eboutique www.EmmaJonesParis.com. The Buyer can pay for his order through different payment methods:

By credit card: Visa, Master Card, CB cards. Credit card numbers are 128-bit encrypted by the software when the order is placed. Orders delivered outside Metropolitan France are payable exclusively by credit card. Secure payment.

By PayPal: Your payments are made directly on the PayPal site via encrypted pages using the SSL (Secure Socket Layer) protocol. www.EmmaJonesParis.com has no access to your bank details.
Article 7.Delivery time and shipping costs
The Buyer will be informed by email of the handling of the parcel with the parcel tracking number. The shipping costs are calculated automatically at the end of your order according to the place of delivery.

Delivery times do not include preparation times, which can therefore lead to a few days of difference, from receipt of your order.
Article 8. Retention of title
The EmmaJonesParis company retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.
Article 9. Anomaly on delivery
Upon delivery of the order, the Buyer must check the conformity and the status of his order and issue, if necessary, all useful reservations concerning apparent defects (missing product, damaged package). The latter must refuse a package with anomalies or a presentation that could suggest a partial or total deterioration of the goods or a theft. In case of return by La Poste following a refusal of receipt for deterioration of the package, the order is reshipped free of charge and in good condition to the customer. The Buyer must declare by email or any other written means any error or anomaly or defect concerning the items received and this within 48 hours of receipt of the package. Article 10. Withdrawal
Under Article L121-20 of the Consumer Code, the Buyer has a period of thirty working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the Seller for refund without penalty, with the exception of return costs, which are the responsibility of the Buyer. To return a product, you must contact customer service and notify them of the desired return, before sending the package at your expense. The return cannot be made on varnishes (for hygienic reasons) and only if the product has never been used, in impeccable condition, as you received it. Items must be returned in their original packaging, along with supporting documents. Items returned incomplete, damaged, damaged or soiled by the Buyer are not taken back, and cannot be reshipped. When returning, if the items are compliant, all costs are refunded except for additional delivery costs chosen by the consumer. Don't forget to include with your submission: the copy of the invoice, the defective product or item properly packaged, the return form that you will have duly completed and signed. Refund : If the Buyer has already received his order: In the event of withdrawal, EmmaJonesParis will refund all payments received for the order, including delivery costs, offered by EmmaJonesParis and without supplement no later than 15 days after the customer's request. EmmaJonesParis however reserves the right to defer reimbursement until it has received the returned products, at the expense of the Buyer. The refund will be made by crediting the customer's bank account corresponding to the bank card used to pay for the order or by the PAYPAL account if the order was paid via PAYPAL. If the order has not yet been shipped: In the event of withdrawal by the Buyer, EmmaJonesParis will reimburse all payments received for the order without undue delay and in any event, no later than 8 days after the Buyer's request. In the event of a partial return of the products ordered or an error in the delivery address by the Buyer, the initial delivery costs will not be refunded. The case of promotional offers: The Buyer may benefit from a conditional promotional offer on the Site, or free delivery, allowing him to obtain a reduction. In the event of return by the customer of only part of the articles having enabled him to benefit from this promotional offer, the Buyer will be refunded an amount equal to the price of the returned product from which will be deducted the reduction applied initially and to which the 'Buyer can no longer claim. Similarly, the Buyer may benefit from a gift for the purchase of one or more products. In the event of return by the Buyer of this product or part of these products, the Buyer must also return the gift he received.
Article 11. Warranty Legal warranty of non-conformity:
In accordance with the legal provisions in force relating to the conformity of the goods with the contract, in the event of non-conformity of a product sold, it may be returned to the company NAIL ADDICT which will take it back, exchange it or refund it within a period of two years maximum from the delivery of the property. The company also reimburses all return costs on simple presentation of supporting documents. Legal warranty against hidden defects: The Buyer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the civil code.
Article 12. Liability
NAIL ADDICT, in the distance selling process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems. In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, NAIL ADDICT adheres to the Service of the Mediator of e-commerce of the FEVAD (Federation of e-commerce and distance selling) whose contact details are as follows: 60 Rue La Boétie – 75008 Paris – http://www.mediateurfevad.fr. Article 13. Intellectual property
All elements of the Site are and remain the exclusive intellectual property of NAIL ADDICT. The user is not authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the Site whether in the form of a photo, logo, visual or text.
Article 14. Personal data
NAIL ADDICT collects personal data from the Customer necessary for the proper performance of the contract (identity, address, telephone number, etc.). NAIL ADDICT undertakes to preserve the confidentiality of the information provided by the User, which he would have to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978 and European Regulation 2016/679. As such, the user has a right to access, modify and delete information concerning him. He can request it at any time via our contact form. NAIL ADDICT processes consumer information in accordance with its Privacy Policy.
Article 15. Applicable law
These distance selling conditions are subject to French law.
Annex
Provisions relating to legal warranties: Article L. 211-5 of the Consumer Code: "To comply with the contract, the good must: 1/Be suitable for the use usually expected of a similar good and, where applicable: - correspond to the description given by the seller and possess the qualities that the latter has presented to the Buyer in the form of a sample or model; - present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling; 2/Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the Buyer, brought to the attention of the seller and which the latter has accepted. » Article L. 217-4 of the Consumer Code: "The seller delivers goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. This period runs from the customer's request for intervention or the provision for repair of the property in question, if this provision is subsequent to the request for intervention. » Article 1641 of the Civil Code: "The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the customer would not have not acquired, or would have given only a lesser price, if he had known them. » Article 1643 of the Civil Code: "He is liable for hidden defects, even if he did not know of them, unless, in this case, he has stipulated that he will not be bound by any guarantee. » Article 1644 of the Civil Code: "In the case of articles 1641 and 1643, the customer has the choice to return the thing and have the price returned, or to keep the thing and have part of the price returned to him, as it will be arbitrated by experts. » Article 1648, paragraph 1, of the Civil Code: "The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. »
